Bond or Miller Act Claims

When unpaid on a private construction project, an unpaid contractor or supplier can file a mechanics lien against the project itself, with the mechanic’s lien attaching directly to the property. On jobs where the state or federal government owns the property, however, there is usually no legal right to file a lien against the government property. Instead, unpaid contractors or suppliers rely on state and federal laws that give unpaid contractors / suppliers the right to file a claim against payment bonds issued on the project.

On federal projects, claims are made pursuant to the Miller Act. On state projects, they are made pursuant to the state’s “Little Miller Act.”

The way these acts typically works is that the prime contractor is required to obtain a payment bond before work begins. After subs and suppliers furnish labor and/or materials, if unpaid, they may file a claim against the provided bond. So, instead of the workman’s security in the property itself, as in private projects, the security is in the payment bond.

Stop Notices

In some states, Stop Notices are available to contractors and suppliers as an alternative to (or in addition to) their Mechanic Lien Rights. A Stop Notice is delivered to the prime contractor or property owner, and demands that they withhold enough funds to pay your claim. If the property owner or prime contractor is in possession of funds at the time your Stop Notice is sent, they will be responsible for payment of your claim if they disburse those funds to other parties.

Typically, after sending these Stop Notices, the property owner or prime contractor will stop paying “down the contracting chain” until your claim is resolved.

If available in your project’s state, the Stop Notice may be a beneficial filing because it frequently does not have deadlines (only effective if the receiving party is holding funds), and because it is a remedy available to you in addition to your mechanic lien rights. Preliminary Notices

A Preliminary Notice must usually be delivered before work begins on a construction project, or within a certain time frame from when materials and/or labor are first furnished. In some states, these notices are called Notices to Owner, NTO, Notice of Contract, NOtice of Non-Payment, Notice of Lien Rights, 20-Day Notice, and Notice of Lease.

Notice requirements are different from state to state, and project to project, and the requirements can be very strict. Some states require notices meet specific form standards, font sizes and styles, and be specially delivered or served.

Notices of Intent to Lien

A Notice of Intent to Lien is required in some states, and is typically sent when unpaid on a construction project after last furnishing labor and/or materials to a project. This notice warns the property owner, prime contractor and/or other party that a mechanics lien or bond claim will be filed unless payment of overdue amounts is made within a certain period of time (i.e. 10 days).

Lien Cancellations

When a “claim” has been satisfied, most adverse parties and states require that the claimant file the appropriate document to “release” or “cancel” the Claim of Lien filed. In many circumstances, a paying party will require that the lien be canceled prior to and simultaneously with payment. Zlien can prepare a professionally drafted lien cancellation and have it recorded by the proper recording office to ensure that the filed lien is canceled.

Further, we offer escrowing services to clients to ease the lien cancellation process. The claim’s payment is placed in a safe and independent escrow account, where it awaits cancellation. When the instrument is canceled, the funds in escrow are released to the claimant.
