A Virginia lien typically only obligates the owner to pay claimants from money it has yet to pay the general contractor. Subcontractors and suppliers who send 40-11 Preliminary Notices to the owner and general contractor before beginning work or supplying materials take the first step to reverse this, and obligate the owner to its claim. The second step is after work is complete, where upon a second 40-11 notice must be sent. This second step is due within 30 days of completion of the claimant’s work.
