In Wisconsin, all claimants must serve a Notice of Intention to File Claim of Lien upon the property owner before filing the Claim of Lien.    Since the Notice of Intent must be served at least 30 days before filing the lien, it must be served within 5 months from last furnishing labor and/or materials…at the very latest. Prime contractors must include a notice of lien rights within their written contract with the property owner, or if the contract is oral, provide a “Notice of Lien Rights” be served upon the property owner within ten (10) days of an oral agreement.  A “prime contractor” includes any party who contracts with the property owner, including architects, construction managers and engineers.

When a mechanics lien has been satisfied by receipt of payment, a lien claimant in Wisconsin is required to deliver an executed “Full Satisfaction of Lien” to the property owner or interested party who satisfied the lien.
