New York Demand for Notice

This notice is not a required filing. However, any party on a public project can deliver to the public body a Demand for Notice of Completion. Within 5 days of the project’s completion, the public body must deliver to you a notice of the same.

This is a useful filing for parties who leave a project early, who may want to lien. Since the lien period starts upon the public project’s completion, this is extra insurance that you will know when this date passes.

New York Mechanics Lien

A party providing services or materials to a construction project in NY may file a mechanics lien against the property if they are unpaid. The lien must be filed within 8 months from last furnishing labor and/or materials. If the work is on a single-family residential project, the time to file is just 4 months from the same date.

A copy of the lien must also be served on the property owner and anyone above the claimant in the contracting chain within 30 days of filing, and proof of delivery must be filed.

New York Mechanics Lien / Bond Claim

In New York, those who performed work on a public improvement and are unpaid may file a mechanics lien against the public improvements funds. The lien must be filed within 30 days of the project’s completion and acceptance by the public entity.

It is vital that notice of the lien be delivered to all required parties and that an affidavit of delivery is attached with the lien.

New York Extension for Mechanics Lien

Unless a mechanic’s lien is foreclosed upon – or enforced by filing suit – the lien expires by law. To prevent this, lien claimants may file for an Extension of the lien. Filing a lien extension extends the validity of the lien for a period of 1 year from the date of the extension. Extensions are not available for single-family residential projects.

When a claim is paid, the party holding the lien may be required to release the lien with the county records.   Liens can be canceled because they expire, or for other reasons.
