When unpaid for materials, labor, services or equipment on a construction project in Colorado, claimants can record a Mechanics Lien. Remember that a Notice of Intent to Lien must be filed 10 days before the filing of this lien. An affidavit certifying that the notice was sent to the property owner must be incorporated with the Lien.
There are two different forms possibly available when filing a Colorado Mechanics Lien, depending on your role in the project.
Mechanics Lien for Prime Contractors
This form should be used by those who contracted directly with the property owner.
Mechanics Lien for All Other Parties
If you did not contract with the property, this is the mechanics lien form to use. This includes all subcontractors, suppliers, equipment lessors, sub-subcontractors, etc.
