Virginia Memorandum of Lien for General Contractors

The construction or mechanics lien, known in Virginia as a Memorandum of Lien, is filed on private construction jobs. Construction liens are available to parties who have performed labor or provided materials to a jobsite, and have not been paid.

In Virginia, Notice to the Owner and/or General Contractor in some form is required upon filing a Memorandum of Lien.

Virginia Notice of Intent to Lien

While not required in Virginia, a party may send any other party a “notice” that they intend to lien a project if payment is not received.

This form advises the party that a lien will be filed if payment is not received within 10 days.

The filing of this document does not suspend or extend the liening period.

Virginia Notice to Mechanics Lien Agent

On one or two family residential projects, if a Mechanics Lien Agent (MLA) has been designated in the building permit, all contractors must provide a preliminary notice within 30 days of starting work or furnishing materials

Virginia Notice to Owner

A Virginia lien typically only obligates the owner to pay claimants from money it has yet to pay the general contractor. Subcontractors and suppliers who send 40-11 Preliminary Notices to the owner and general contractor before beginning work or supplying materials take the first step to reverse this, and obligate the owner to its claim. The second step is after work is complete, where upon a second 40-11 notice must be sent. This second step is due within 30 days of completion of the claimant’s work.

Virginia Notice to Contractor

Whenever one performs work on a state project in Virginia, but who has not contracted directly with the general contractor, that party must provide a written notice to the general contractor within 180 day of last furnishing labor or materials to the project to preserve its claim against the contractor’s payment bond.

Virginia Mechanics Lien Release

Private and Public construction liens and statements must be canceled once payment has been received, or for any other reasons.

Lien cancellations are certificates filed with the recorder to cancel the previously filed instruments.
