FOR STARTERS – WHAT IS THE SCR?
If you’re working on construction projects in Utah, you should be familiar with the State Construction Registry (SCR). You can find it here: http://src.utah.gov.
This is a statewide database of construction projects in the state. You can get information on construction projects where you’re performing work, see who else is working on the project, and file certain notices.
NOTICE REQUIREMENTS
- Notice of Commencement: An original contractor should file a Notice of Commencement no later than 15 days after either the building permit is issued or the commencement of physical construction on the project.
- Preliminary Notice: Any party who is not an original contractor (i.e. all subs and suppliers, but not individual laborers) must file a Preliminary Notice within 20 days of first furnishing labor, materials, and/or equipment to a project. Notices filed after this time period are effective only for 5 days after the filing day, and beyond.
THE MECHANICS LIEN
Generally, contractors, subcontractors, suppliers, equipment lessors, laborers and design professionals all have lien rights in Utah.
- Referred to as “Claim of Lien”
- If a Notice of Completion is filed, the lien is due within 90 days from its filing. If a Notice of Completion is not filed, the lien is due within 180 days from the final completion of the project.
- Action to enforce lien must be filed within 180 days from the date the Claim of Lien is filed.
