South Dakota Mechanics Lien
When unpaid on a private construction project in South Dakota, parties who furnished labor and/or materials thereto may file a Lien Statement within 120 days of last furnishing labor/materials to preserve their claims for payment.
South Dakota Mechanics Lien Release
If payment has been received on a claim, or for other reasons, a claimant may release its lien against a property.
South Dakota Location Notice
To protect itself from sub-subcontractor and supplier liens on a project, the Prime Contractor must file a Notice of Commencement and post a Location Notice at the jobsite.
South Dakota Notice of Commencement
In South Dakota, Prime Contractors may protect itself from liens filed by sub-subcontractors and suppliers by filing a Notice of Project Commencement within thirty (30) days of the commencement of work. A Location Notice must also be displayed at the jobsite.
South Dakota Notice of Furnishing
In some circumstances, sub-subcontractors and suppliers must serve a “Notice of Furnishing Labor or Materials” upon the prime contractor to preserve its lien rights. This is required when the prime contractor has filed a Notice of Commencement at the beginning of construction, and must be served within 60 days of the last furnishing or labor and/or materials by the claimant.<

Property Owner may demand that another party provide a list of lien accounts on the property.
