NOTICE REQUIREMENTS
- Preliminary Notices are typically required in Oregon. The “Notice of Right to Lien” must be delivered to the Owner (and Lender, if any) within 8 days of furnishing any labor or materials. Those who contract directly with the owner are not required to send this notice.
- Original Contractors on residential projects and improvements that are greater than $1,000.00 must send an “Information Notice to Owner” before work begins.
THE MECHANIC’S LIEN
Prime Contractors, Subcontractors, Sub-Subs, Architects, Engineers, Suppliers and Equipment Lessors all have lien rights in Oregon.
- Referred to as “Claim of Construction Lien”
- Liens must be filed within 75 days from the earlier date of: (a) the last furnishing of labor or materials to the site by the claimant; or (b) completion of the entire project.
- Action to enforce lien must be filed within 120 days from the filing of the mechanic’s lien.
TERMINOLOGY
Original Contractor is any contractor who contracts directly with the property owner.
Last Day Work / Materials Furnished does not include “punch list” items or other trivial work, or the correction of substandard work by the contractor.
