Oregon Claim of Construction Lien
The construction or mechanics lien, known in Oregon as a Claim of Lien, is filed on private construction jobs.
Construction liens are available to parties who have performed labor or provided materials to a jobsite, and have not been paid.
Oregon Information Notice to Owner
Parties contracting directly with the property owner, on any residential project or residential improvement priced at more than $1000, are required by the Board of Contractors to deliver an “Information Notice to Owner of Construction Lien” to the property owner before work ever begins at the project.
Original contractors are required to deliver this document, or may lose lien rights.
Oregon Notice of Completion
An owner or original contractor can record a Notice of Completion or Notice of Abandonment when work has ceased on a project. This notice ensures that the lien period begins as soon as possible, and creates an affirmative date for when the lien period begins.
Oregon Notice of Intent to Lien
While not required in Oregon, a party may send any other party a “notice” that they intend to lien a project if payment is not received.
This form advises the party that a lien will be filed if payment is not received within 10 days. The filing of this document does not “suspend” the liening period.
Oregon Notice of Non-Responsibility
In Oregon, if work is being done on property at the direction of someone other than the owner (i.e., a tenant), the owner can avoid liability from any claims of liens by filing a “Notice of nonresponsibility.”
The notice must be filed and posted in some conspicuous place on the site.
Oregon Notice of Right to Lien
Oregon Partial Lien Satisfaction
In Oregon, those who claim liens are required to record a “Partial Satisfaction” of the claim in the event any amounts are paid to the claimant. If payment is received and the lien must be partially released, this product prepares that partial satisfaction document, and files it with the appropriate county.
Oregon Public Written Notice of Claim
When unpaid on a public works project in Oregon, you can file a “Written Notice of Claim” to make a formal claim against the payment and/or performance bond issued for the project.
