NOTICE REQUIREMENTS
Pre- Work Notices
- Prime Contractor: Prime Contractors must give a disclosure notice to the owner prior to receiving any payment on the project.
- Subcontractors on Residential Owner-Occupied Projects must, prior to beginning work, get the general contractor to obtain the written consent of the owner for the subcontractor to lien the project.
- Those Renting Equipment must give notice to the property owner within 5 days of first furnishing equipment or machinery.
- Architects / Engineers need not send a Notice of Intent to Lien or obtain the consent of an owner on an owner-occupied property.
Pre-Lien Notices
- Subcontractor/Supplier must give written notice of their intent to lien the project 10 days before filing a lien.
Special Notice for Residential Property Being Sold
- If a property owner has filed / posted a “Notice of Intended Sale” indicating that the residential property will be sold on a certain date, all claimants must record a Notice of Rights at least 5 days before the stipulated closing date.
THE MECHANICS LIEN
Generally, contractors, subcontractors, suppliers, equipment lessors (to commercial projects only), laborers and design professionals all have lien rights in Missouri.
- Referred to as “Claim of Lien”
- Those Renting Equipment must file their Claim of Lien within 60 days from when the equipment is removed from the property. All others must file their Claim of Lien within 6 months from the last furnishing of labor and/or materials.
- Action to enforce lien must be filed within 6 months from the date the Claim of Lien is filed.
