Mississippi Mechanics Lien
Those who contract directly with the property owner are allowed to file construction liens – called “Lien Notice” – as per Miss. Code Ann. § 85-7-131.
A Lien Notice is filed by a Contractor who have not been fully paid for services rendered.
Mississippi Mechanics Lien Release
In the event a claim is satisfied, a lien expires, or for any other reason, a lien can be released by filing a Lien Release and Cancellation.
Mississippi Stop Notice
In Mississippi, those without a direct contract with the owner are not allowed to file a traditional “lien.” The remedy for these subcontractors is a “Stop Notice,” and the filing of this document with the Chancery Records as Lis Pendens. Miss Code Ann Sect. 85-7-181.
A subcontractor or supplier should first check to see if the general contractor provided a payment bond to the owner, as the bond would be in lieu of the subcontractors right to a stop notice.
Stop notices may be filed at anytime, but are only effective against money not yet paid by the owner to the prime contractor.
Mississippi Notice of Intent to Lien
In Mississippi, there is no requirement that a Notice of Intent to Lien be sent. However, you may be interested in delivering a Notice of Intent to the property owner and/or general contractor before filing a Lien or Stop Notice.
This Notice of Intent to Lien provides the noticed party 10-days to arrange payment before the Lien is filed.
Remember that this is not a required filing, and will not suspend or extend the time period allowed to you to file a lien. In Mississippi, those who contract with the owner have 12 months from the date a debt becomes due to lien. Others can send a Stop Notice at any time, but it will only have effect to money in the owner’s hands, and not yet paid to the prime contractor.
