NOTICE REQUIREMENTS
General Contractor: Must provide General Contractor’s Notice within the written contract. If not within the written contract, must be provided to owner within 10 days after work has been agreed upon.
This Notice Not Required If:
- Claimant will not and has not contracted with any other subcontractor or suppliers to provide labor, skill or materials to the project;
- Property is not agricultural or residential property, and has more than 5,000 total usable floor space;
- Property is residential with more than four family units;
- The Owner / Contractor are the same person, or substantially the same persons.
All Others: All other parties must provide a Lien Claimant’s Notice within 45 days after first furnishing labor and/or materials to a project – at the latest. Best protection to send as immediately as possible.
This Notice is Not Required If:
- Property is not agricultural or residential property, and has more than 5,000 total usable floor space;
- Property is residential with more than four family units.
THE MECHANICS LIEN
- Referred to as “Mechanics Lien Statement”
- Must be filed and served on the property owner and the party who contracted with the claimant within 120 days after last furnishing labor and/or materials to the project.
- Must commence action to foreclose on the lien within 1 year after last furnishing labor and/or materials to the project.
- Generally, most parties on a project have lien rights in MN. A supplier to a supplier does not have lien rights.
