Michigan Discharge of Lien
A Claim of Lien should be discharged upon receipt of payment for the claim, or for other reasons provided by law.
Michigan Mechanics Lien
When unpaid on a construction project in Michigan, parties can file a Claim of Lien within 90 days from when they last furnished labor and/or materials to the job.
Michigan Notice of Commencement
At the start of construction, or thereafter if not previously filed, an owner is required to record a Notice of Commencement with the county where the project is located.
Michigan Notice of Furnishing
To preserve lien rights, subcontractors, suppliers and laborers are required to deliver a Notice of Furnishing to the general contractor and Designee listed in the Notice of Commencement. Subs and Suppliers must serve this notice within 20 days of furnishing the first labor and/or materials. Laborers must serve the notice within 30 days of their wages becoming due and unpaid.
Michigan Request for Notice of Commencement
Michigan Construction Lien Act requires owners or tenants to file a Notice of Commencement on every construction project, and to post it at the jobsite. This Notice has information in it that must be known to properly file your lien and preliminary notices.
If this is not filed, or you cannot find it, you can make a request for the Notice of Commencement directly upon the property owner and/or general contractor.
