NOTICE REQUIREMENTS
- Subcontractors must give written Notice to Owner of Intention to Claim a Lien within 120 days from last furnishing labor/materials to a project.
THE MECHANICS LIEN
In Maryland, any party furnishing labor/materials for a building may file a construction lien. There are no limitations on certain tiers of contractors on the filing.
- Referred to as “Petition to Establish a Mechanic’s Lien”
- Must be filed within 180 days after labor/materials last furnished to the project.
- Lien expires if it is not foreclosed upon within one year after the lien was filed.
- In Maryland it is possible to file a petition to establish and enforce a mechanics lien in one filing. This is called a “Petition to Establish and Enforce Mechanics Lien.”
- If the lien claimant is a corporation, it must be registered to do business in Maryland in order to maintain a lien action.
