Louisiana Notice of Contract
In Louisiana, anyone who contracts with the owner for more than $25k must file a Notice of Contract before the delivery of materials or labor to the project.
Property Owners may also file this document to ensure that the lien filing period is shortened at the end of the project (This also requires the filing of the Notice of Termination at the end of the project).
Louisiana Notice of Intent to Lien
While typically not required in Louisiana, a party may send any other party a “notice” that they intend to lien a project if payment is not received.
This form advises the party that a lien will be filed if payment is not received within 10 days.
The filing of this document does not “suspend” the liening period.
Louisiana Notice of Lien Rights
Contractors must provide property owners with a “Notice of Lien Rights” if (1) Renovation or repair work is being performed on a single family residence actually occupied by the property owner; and (2) You contract with that owner.
The Residential Truth and Construction Act requires that the Notice of Lien Rights be delivered to the owner “for such owner’s…signature.” We send the notice and request a signature from the owner, but cannot guarantee the owner will sign.
Louisiana Notice of Non-Payment
Material suppliers on state projects must deliver a notice of non-payment to the prime contractor and public entity within 75 days from the last day of the month of furnishing labor and/or materials. This includes the preparation and delivery of this notice.
Louisiana Notice to Owner of Obligation
In Louisiana, parties who did not contract with the owner may, but need not, deliver a notice to the owner notifying them of their role in the project.
If the notice is delivered, the owner is required to notify you when the project is substantially complete.<br><br>If the owner fails to notify you, the owner may be liable for all costs and attorney fees for the establishment and enforcement of your claim.
Louisiana Statement of Claim and Privilege
The construction or mechanics lien, known in Louisiana as a Statement of Claim and Privilege, is filed on private construction jobs.
Construction liens are available to parties who have performed labor or provided materials to a jobsite, and have not been paid.
Louisiana Mechanics Lien / Bond Claim
A Public Statement of Claim should be filed on public or government projects when labor has been performed or materials provided, and you have not been paid.
The sworn statement is filed against the project in the local records and sent to all interested parties.
