NOTICE REQUIREMENTS
* Indiana is generally a non-notice state; therefore, notice is typically not required prior to work or prior to filing a mechanics lien.
* Residential Projects / Those Who Did Not Contract with Owner: Notice is required on residential projects (new and renovation) with an owner-occupier or intended owner-occupier (i.e. is being built to be sold to an owner who will occupy it). All parties who did not contract directly with the owner must file a Pre-Lien Notice to Owner of Mechanic Lien Rights.
* New Construction: Within 60 days of first furnishing labor and/or materials
* Renovation: Within 30 days of first furnishing labor and/or materials
THE MECHANICS LIEN
* Referred to as “Sworn Statement and Notice of Intention to Hold Mechanic’s Lien”
* Type 1 Projects (Residential), must be filed within 60 days of last furnishing labor and/or materials to the project. Type 2 and 3 Projects (all others) must be filed within 90 days of last furnishing labor and/or materials to the project.
* Notice must be delivered to the property owner within 3 days of filing.
* Action to enforce lien must be filed within 1 year from the lien’s filing.

NOTICE TO OWNER OF PERSONAL LIABILITY
Can be filed by any party (not in contract with owner) at anytime. It acts to hold the property owner personally liable for amount due to the claimant, but is only effective as to funds in the hands of the owner and not yet paid to general contractor.
