Arkansas Mechanics Lien
A Claim of Lien can be filed by parties who furnish labor and/or materials to a project, and are unpaid. The Claim of Lien must be filed within 120 days from when labor and/or materials are last furnished.
Arkansas Notice of Intent to Lien
In Arkansas, lien claimants must properly serve a Notice of Intent to Lien upon the property owner at least 10 days before filing a mechanics lien on the project. Evidence of the delivery must be retained, as it must be filed along with the lien.
Arkansas Notice to Owner and Contractor
Within 75 days of last furnishing labor and/or materials to a project, those unpaid on commercial projects, and residential projections with 5 or more units, must deliver a Notice to Owner or Contractor to preserve its lien rights. A copy of the notice and proof of service must be attached to any liens later filed.
Arkansas Pre-Construction Notice to Owner
On residential projects (4 units or less), prime contractors must deliver a Pre-Construction Notice to Owner before work begins on the project. All other parties to the project may deliver the notice to further protect its lien rights.
