Alabama Mechanics Lien

A Statement of Lien may be filed by any party who has not been paid for construction work on a project in Alabama.

If the party did not contract with the owner, before filing this document they must send a Notice of Unpaid Lien.

Those who did contract with the owner, or material suppliers who sent preliminary notice before delivering supplies, will have a full price lien upon filing this document. Others will have an unpaid balance lien.

Alabama Notice of Unpaid Lien

Those who did not contract with the property owner directly are required to deliver a Notice of Unpaid Lien to the property owner before filing a mechanics lien.

Delivery of this notice puts the owner on notice that a lien is claimed, and requires the owner to withhold funds sufficient to satisfy your claim. The earlier it is sent, the more likely it is to be received before the owner disburses those funds to the prime contractor, and the claimant loses any rights thereto.

Notice of Bond Claim must be filed with the surety at least 45 days before filing a lawsuit to enforce your rights against a bond. This product includes the preparation and filing of your bond claim for a Alabama Public Works Project.

Alabama Release of Lien

After receipt of payment to satisfy a lien claim, after a lien expires, or for any other reason, a lien may be canceled with the recording office.

Alabama Notice of Intent to Lien

This is not a required filing in Alabama, but any party may have a Notice of Intent to Lien delivered to any other party, advising them that if payment is not received a lien will be filed against the property.

This notice allows the notified party ten (10) days to make payment. The filing of this document does not suspend or extend the lien period.
